1. Acceptance of Terms
By accessing or using gaintally.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and GainTally(“we,” “us,” or “our”), the company that operates this Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.
2. Service Description
GainTally is a free, data-driven clean energy calculator platform that provides US homeowners with estimates for solar energy, electric vehicles, and home energy efficiency investments. The Service includes 20 calculator tools — 10 solar, 6 EV, and 4 energy efficiency — powered by publicly available data from the National Renewable Energy Laboratory (NREL) and the U.S. Energy Information Administration (EIA).
GainTally is an independent platform. We have no affiliation with, and do not control or receive compensation from, any solar installer, EV dealer, or energy efficiency contractor based solely on calculator results. We are not a financial institution, licensed financial advisor, or registered investment adviser.

THE INFORMATION PROVIDED ON GAINTALLY IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, LEGAL, TAX, OR PROFESSIONAL ADVICE OF ANY KIND. CALCULATOR RESULTS ARE ESTIMATES, NOT GUARANTEES.
All estimates are based on user-provided inputs combined with NREL and EIA public data sources. Typical accuracy is ±10–15% compared to industry benchmarks (PVWatts, DOE, ENERGY STAR). Actual results will vary based on local conditions, installer quotes, utility rate changes, weather, and individual usage patterns.
Before making any investment decision over $5,000, always consult one or more licensed professionals, which may include:
- A licensed solar installer or contractor
- An authorized EV dealer or certified mechanic
- A certified home energy auditor (BPI or RESNET)
- A certified financial planner (CFP) or CPA
- A licensed attorney for tax credit eligibility questions

4. Accuracy Limitations
4.1 Data Source Accuracy
- NREL PVWatts solar data: ±10% typical margin. NREL updates annually.
- EIA electricity and gas rates: ±5% typical margin. EIA updates quarterly.
- ENERGY STAR appliance data: ±15% typical margin.
4.2 Input Quality Dependency
Calculator accuracy depends on the quality of inputs you provide. An incorrect ZIP code, energy usage figure, or system size will produce an incorrect output. We are not responsible for errors resulting from user-provided inputs.
4.3 Tax Credit and Incentive Changes
Federal tax credits and state incentive programs change frequently. The federal residential solar credit (25D) and EV credit (30D) have undergone significant modifications through the Inflation Reduction Act and subsequent legislation. Always verify current rates and eligibility requirements with the IRS or a qualified tax professional before relying on any estimate from this Service.
5. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAINTALLY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSS, MISSED TAX CREDITS, INCORRECT SYSTEM SIZING, OR DECISIONS MADE IN RELIANCE ON CALCULATOR RESULTS.
In no event shall GainTally's total cumulative liability to you exceed fifty US dollars ($50) or the total amount you have paid for the Service in the preceding twelve (12) months, whichever is lower. Because GainTally is a free service, this cap is effectively $50.
GainTally shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including natural disasters, acts of government, internet outages, or third-party API unavailability (force majeure).
Some jurisdictions do not allow the exclusion of certain warranties or limitations on implied warranties. In such jurisdictions, the above limitations may not apply to you.
6. Prohibited Uses
You agree not to use the Service to:
- Scrape or mass-collect data: Use automated tools, bots, spiders, or scripts to extract content or data at scale without our prior written consent.
- Reverse engineer: Attempt to reverse engineer, decompile, or extract the source code, formulas, or proprietary algorithms underlying the Service.
- Infringe intellectual property: Copy, reproduce, redistribute, or create derivative works from Service content (including calculator logic, design, and copy) without authorization.
- Abuse email opt-in: Submit false email addresses, use the opt-in form for spam purposes, or attempt to bypass rate limits or honeypot fields.
- Disrupt the Service: Attempt to overload, crash, or interfere with the availability or performance of the Service or its infrastructure.
- Engage in any unlawful activity: Use the Service for any purpose that violates applicable local, state, federal, or international law.
7. Intellectual Property
7.1 Calculator Outputs — Free to Use
Numerical results, charts, and estimates produced by the calculators are free to use for personal, educational, or commercial purposes. No attribution to GainTally is required, though it is appreciated. This is a deliberate transparency commitment — our goal is to help you make informed decisions, not to restrict how you use your results.
7.2 Source Code and Design — Copyrighted
The source code, formulas, design, text, graphics, and user interface of GainTally are © 2026 GainTally. All rights reserved. Unauthorized reproduction or distribution is prohibited.
7.3 Trademark
“GainTally” is a trademark of GainTally. You may not use this mark without prior written permission.
7.4 Third-Party Data Attribution
- Solar irradiance and production data: National Renewable Energy Laboratory (NREL) / U.S. Department of Energy
- Electricity and natural gas rate data: U.S. Energy Information Administration (EIA)
NREL, EIA, ENERGY STAR, IRS, and other government agency names, logos, and data remain the property of their respective owners.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of [State of GainTally kayıt eyaleti] and the federal laws of the United States, without regard to conflict of laws principles.
8.1 Binding Arbitration
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved by informal negotiation shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. 8.2 Class Action Waiver

8.3 Filing Deadline
Any claim or cause of action arising from or related to these Terms or the Service must be filed within one (1) year after the claim or cause of action arose, regardless of any applicable statute of limitations.
8.4 Venue for Non-Arbitrable Claims
